The claimant was doing straight arm rows on a TRX suspension training system under the supervision of the insured personal trainer during a group exercise class. While the trainer turned to assist another client, one of the straps on the TRX system broke, causing the claimant to fall hard on his right side. The claimant experienced pain in his lower back and had to go to hospital, attend subsequent doctor visits and purchase prescription medication. As a result of the injury, the claimant had to take a week off work to recover. The claimant asserted that the insured personal trainer failed to properly check the TRX system and sought compensation from the trainer including for the time off work as well as the cost of medical treatment and medications.
