When a middle aged man decided to go on a health kick and lose weight he enlisted the help of a personal trainer, and after undergoing the pre-assessment was prescribed a 12 week exercise program.

During one of the sessions his personal trainer, a recent graduate with little experience, ordered him to perform a particular exercise that resulted in him suffering a severe spinal injury. Forty-eight hours later he could barely move and had to undergo spinal fusion surgery on his back.

The man launched a law suit against the trainer and his employer which dragged on through the court system for two years. Eventually the court determined that the exercise prescribed was inappropriate for a person of his age and physical condition, and that his injuries were caused as a result of the trainer’s breach of his duty of care. The trainer and his employer were found negligent for failure to provide appropriate risk management in respect to the programme, devising an unsafe and unsuitable training programme, and failing to train/supervise.
